This course explores alternative forms of dispute resolution (ADR)--mediation, arbitration, negotiation, and online dispute resolution in comparison to the judicial system. We examine their usage over the past 300 years and relevance today. Throughout the course we investigate the contributions and concerns raised by the application of technologies including artificial intelligence for conflict resolution. What are the benefits and drawbacks for using ADR rather than court for commercial, environmental, family, labor, educational, and community disputes? What ethical questions emerge when using AI to facilitate or resolve disputes? Whose interests are served by ADR? We will also briefly explore international dispute resolution and consider its similarities and differences to ADR in this country.

Open to Legal Studies majors only. LEGAL 101 This course fulfills requirements for the Information Technology Minor requirement. Contact the instructor to enroll if you are not a Legal Studies major at lwing@legal.umass.edu.
